Au niveau national, le Code de l’Environnement a vu le jour en septembre 2000. Il rassemble tout ou partie de lois concernant

- la protection de la nature,
- la qualité de l’air et de l’eau,
- les industries et les activités polluantes,
- les déchets y compris les déchets radioactifs,
- la protection du paysage.

Il incorpore l’ancien Livre II du code rural, réparti entre le Livre III (espaces naturels protégés) et IV (faune, flore, chasse et pêche) du code de l’environnement. Au travers de ce code, les espèces végétales sont protégées soit directement soit indirectement par la protection d’un territoire.

The old Book II of the Rural Code is also included and comprised in the Book III (Protected Natural Areas) and Book IV (fauna, flora, hunting and fish) of the Environmental Code. Plant species are protected by this Code, either directly or indirectly, through the protection of territories.

Concernant les espèces végétales sauvages, il existe 3 régimes de protection:
Concerning wild plant species, there are 3 different statuses of protection :

- Régime de protection intégrale : par un arrêté interministériel du 20 janvier 1982 (modifié le 15/09/1982 et le 31/08/1995) fixant une liste de 400 espèces végétales en annexe I. Cet arrêté a été complété par des Arrêtés interministériels fixant des listes régionales (22) et également pour les départements d’Outre-Mer (Réunion, Guadeloupe, Martinique).
Status of absolute protection: through the inter-ministerial decision of the 20^th January 1982 (modified by the decisions of the 15/09/1982 and the 31/08/1995), establishing a list of 400 plant species in appendix I. This decision was supplemented by other inter-ministerial decisions establishing regional lists (22) and lists for the overseas departments as well (Réunion, Guadeloupe, Martinique).

- Régime de protection partielle : par un arrêté interministériel du 20 janvier 1982 (modifié le 15/09/1982 et le 31/08/1995) fixant une liste de 27 espèces végétales en annexe II. Ce sont des espèces pouvant faire l’objet de récoltes soumises à autorisation.
Status of partial protection: through the inter-ministerial decision of the 20^th January 1982 (modified by the decisions of the 15/09/1982 and the 31/08/1995), establishing a list of 27 plant species in appendix II. These are species that can be collected only under permission.

- Régime de réglementation préfectorale : par la mise en application d’un arrêté ministériel du 13 octobre 1989 (complété par un arrêté ministériel du 5 octobre 1992) pour les espèces menacées par une exploitation importante.
Status of prefectural regulation : through the application of the inter-ministerial decision of the 13^rd October 1989 (supplemented by the inter-ministerial decision of the 5^th October 1992) for species endangered by intensive exploitation.

Concernant les territoires, leur protection contribue directement ou indirectement à la sauvegarde de la flore.

- Les Parcs Nationaux créés par la loi de 1960, sont actuellement au nombre de 7. Une modification en cours de cette loi devrait permettre la création de 3 nouveaux Parcs Nationaux.

- Dispositions prévues par la loi Montagne et par la loi Littoral.

Concerning the territories, their protection contributes directly or indirectly to the protection of the flora.

- Actually, there are 7 National Parks, created by a law of 1960. A modification of this law that is under way, will allow the creation of 3 other National Parks.

Related regulations anticipated in the legislation for the Mountain and the Coast.

En dehors des protections réglementaires, la protection des territoires peut se traduire par l’acquisition par l’Etat ou des collectivités territoriales de zones biologiquement riches.

La création d’une taxe pour les espaces naturels sensibles dont le produit est versé aux départements permet à ceux-ci d’acquérir en vue de protéger de nombreux territoires d’intérêt patrimonial.

Besides the regulatory protective measures, the protection of territories is also implemented by establishing biologically rich zones by the State or local authorities. The establishment of a tax for sensitive natural species, that is returned to the local authorities, allows them to set up several protected areas of patrimonial interest.
